Vattnet och dess stränder har alltid lockat människor. Många vill bo vid vatten och stränder. Kuster är också naturliga rekreationsplatser för många. Strandskyddslagstiftningen finns för att se till att Sveriges stränder även i framtiden är tillgängliga för allmänheten. Den här uppsatsen handlar framförallt om fastighetsbildning vid strandskyddsdispens och hur väl fastigheterna stämmer överens med de tomtplatser som utmärks i dispensen.

Det övergripande syftet med arbetet är att förbättra tillgången till landets stränder utan att inskränka den enskildes äganderätt allt för mycket. Målet är att ge förslag som kan underlätta arbetet med tomtplatsavgränsningar och fastighetsbildning.

Som metod har ett antal intervjuer med sex kommuner i länet samt med ett antal förrättningslantmätare utförts. Det har också gjorts en studie av dispens- och förrättningshandlingar.

Intervjuerna gav svar på hur kommunerna och lantmäteriet arbetar i frågan om fastighetsbildning i strandnära lägen. Studien av dispens- och förrättningshandlingarna visade hur otydliga kommunerna ofta är och att det till och med ofta saknas anvisad tomtplats i handlingarna.

Ett problem som återkommer är bristen på kunskap om fastighetsbildning hos kommunerna. Därför bör det ges mer undervisning i fastighetbildningsfrågor. Ett annat förslag är att lantmäteriet tar över hanteringen av tomtplatsavgränsningar. Det skulle dessutom vara bra om allmänheten fick mer kunskap om hur lagstiftningen fungerar samt skillnaden mellan tomt och fastighet.

To live close to shores have always attracted people. Beaches and shores are also natural recreations sites. The Swedish shore protection law exists to ensure that the shores of Sweden are accessible to the public also in the future. This essay primarily concerns theregistration of property in shore protected areas and how the property borders follow the plot restriction borders.

The overall purpose of the study is to improve the access to the shores and beaches without restricting the individual’s property rights too extensively. The aimis to givesuggestionswhich can facilitatethe workwith plot restriction and registration of property.

Six municipalities and a couple of national land surveyor in Gävleborg have been interviewed and a study of public documents regarding the regulation has been carried out as method for this essay.

The interviews gave answers to how the municipalities and Lantmäteriet (Swedish National Land Survey) worked with the question in hand. The study showed that the plot restriction border often is marked unclear in the regulation document, sometimes even missing.

A recurring problem is the lack of knowledge of registration of properties in the municipalities. They should therefore be given more education in that subject. Another proposal would be that Lanmäteriet took over the administration of plot restriction. It would also be of great gain if the public were to learn the difference between plot and real estate.
