Abstract [sv]

Flottningens bidrag till Sveriges skogsindustri och ekonomiska utveckling har varit betydande och är nu en svunnen epok efter att Klarälven avlystes som sista allmänna flottled år 1991. De allmänna flottlederna utgjorde en sträcka på över 30 000 km och har satt sina spår då det idag finns många kvarlämningar efter flottningen i form av dammar och andra anläggningar. Flottningsanläggningar har i vissa fall ett högt kulturvärde men i många fall är de i allt sämre skick vilket i sin tur medför risk för miljöskador, personskador och andra typer av risker. I många fall finns det ingen att rikta ansvar mot avseende ägande, avveckling eller förvaltning på grund av att de klassificeras som herrelös egendom, det vill säga det finns ingen som i rättslig mening är utsedd ägare eller underhållsansvarig.

Grunden till de problem som uppstår beror dels på flottningens betydelse för samhällsekonomin vilket skapade incitament för politiker att reglera verksamheten och relaterad lagstiftning så att flottningen gick från att vara ett enskilt intresse till ett allmänt intresse. Staten fick på detta sätt ett större inflytande och kunde besluta om att inrätta allmänna flottleder vilket idag resulterat i herrelösa flottningsanläggningar då flottningsföreningarna som var ansvarig inte existerar längre. I utredningen SOU 2014:35 framgår det av rådande regelverk att förvaltning av herrelösa flottningsanläggningar baseras på frivillig basis. Vidare poängterar utredningen att det aktuella regelverket gällande kvarlämnade flottningsanläggningar inte fyller någon större funktion och att frågan om vem som ska ställas ansvarig måste få ett klargörande.

Problem rörande ansvarsfrågan för herrelösa flottningsanläggningar konstateras runt om i landet av representanter från både allmänna och enskilda. Därför har det ansetts angeläget att genom denna studie utreda hur ansvarsfrågan hanteras avseende ägande, förvaltning och avveckling och om det föreligger regionala skillnader i hanteringen.

Syftet med denna studie är således att ta reda på hur ansvarsfrågan av herrelösa anläggningar hanteras i ett urval av län och även utvärdera om, och i så fall på vilket sätt, hanteringen skiljer sig åt regionalt. Studien bidrar samtidigt till att uppmärksamma ett problem som inte är högt prioriterat idag. Herrelösa flottningsanläggningar utgör idag ett rättssäkerhetsproblem och saknar ett tydligt rättssubjekt. För att besvara studiens frågeställningar har berörda länsstyrelser fått svara på en enkät varav två respondenter även intervjuats. En litteraturstudie avseende aktuella utredningar har också genomförts och olika rättsfall har studerats.

 

Abstract [en]

Timberfloating has had a major impact on Sweden's forest industry. The era ended in 1991 with Klarälvens' closure as a public floatway. The public floatways stretched over 30 000 kilometers and left behind abandoned dams and other structures. While some timber floating facilities can carry a high cultural value, most of the facilities are slowly decaying which causes risk for environmental and safety hazards. The issue of ownership, dismantling and management of the abandoned timberfloating facilities remains unsolved due to some of their classification as ownerless property. Nor the state or landowners on whose properties these facilities reside on have any legal obligation to address or preserve the facilities.

 The root of the problem is partly caused by the timberfloatings significance regarding Sweden's economy. Due to timberfloatings making up a big part of the Swedish economy it prompted politicians to regulate the industry and its legislation making it go from a private to a public interest. The state gained a bigger influence over the timber floating industry enabling politicians to introduce public floatways ways which today has resulted in ownerless facilities because the timberfloating association, who was responsible, ceased to exist.

 The government inquiry SOU 2014:35 concluded that the management of the ownerless facilities builds on a voluntary basis due to existing legal framework. The inquiry pointed out that the existing framework regarding ownerless timber floating facilities have had no practical function and underscores the need for clarification of who is supposed to manage these facilities. The recognition of the responsibility dilemma surrounding ownerless timberfloating facilities by both public and private swears amplifies the need to investigate the question of ownership, management and dismantling.

 This study aims to conduct research on management of these facilities across a number of counties and evaluate if any regional variations exist. It also aims to lift a not so prioritized issue that will cause problems in the future. The ambition is to clarify the responsibility question regarding timberfloating facilities since they lack a clear legal subject. To perform the study relevant counties have participated in a survey and two relevant counties have also been subjected to an interview. A literature study has also been concluded consisting of state inquiries and legal cases.
