Abstract [en]
In 2009, condominiums were introduced as a new form of housing in Sweden. This tenure allowed people to have ownership rights to an apartment in a multi-family building. According to the proposal, the goal of this new form of tenure was to create diversity and increase supply in the housing market. Currently, condominiums have not had the significant impact on the housing market that was expected according to the proposal. As of 2024, there were approximately4 500 condominiums in Sweden according to Lantmäteriet. In Denmark, the equivalent condominiums are called ejerlejligheder, whichwere introduced in 1966 to counteract the housing shortage. Ejerlejlighederare the most established form of tenure in Denmark.
The purpose of the study is to find a way to streamline the Swedish property formation process for condominiums using the Danish model. The authors conducted interviews with relevant stakeholders in the field to gain a deeper understanding of the property formation process, in addition to the literature studied. To identify the shortcomings that delay the process and the similarities and differences between the property formation processes in Sweden and Denmark, the authors created a flowchart of the property formation process for condominiums using the interview results for both Sweden and Denmark.The authors compiled 52 cadastral cases to determine the average processing times in various municipalities in Sweden. A corresponding compilation could not be conducted in Denmark because the authors did not have access to the necessary data. Instead, the Danish respondent provided a timeframe forproperty formation in the country.
The results of the study show that Denmark's property formation process is more efficient than Sweden's because licensed surveyors prepare the property formation documents, which are then sent to the central Danish Geodata Agency for a decision. In Sweden, the property formation documents are prepared by consultants for various municipal or state surveying authorities. According to the respondents in Sweden, the requirements for documentation vary between different officials and surveying authorities. To streamline the property formation process for condominiums, the authors suggest, inspired by the Danish system, establishing a dedicated department for 3D properties and condominiums. Since property formation currently varies depending on the official and surveying authority, this would lead to a standardized property formation process across the country and reduce confusion about the documentation requirements for property legal consultants.

År 2009 introducerades ägarlägenheter som en ny boendeform i Sverige. Denna upplåtelseform möjliggjorde för människor att ha äganderätt till en lägenhet i ett flerbostadshus. Målet med den nya upplåtelseformen var enligt propositionen att skapa mångfald och tillskott på bostadsmarknaden. I dagsläget har inte ägarlägenheter haft stor genomslagskraft på bostadsmarknaden som det var förväntat enligt propositionen. År 2024 fanns enligt Lantmäteriet cirka 4 500 ägarlägenheter i Sverige. I Danmark kallas motsvarande ägarlägenheterför ejerlejligheder och infördes år 1966 för att motverka bostadsbristen. Ejerlejligheder är den mest etablerade upplåtelseformen i Danmark.
Syftet med studien är att hitta ett sätt att effektivisera den svenska fastighetsbilningsprocessen för ägarlägenheter med hjälp av den danska modellen. Författarna genomförde intervjuer med relevanta aktörer inom området för att få en djupare förståelse kring fastighetsbilningsprocessen, utöver den litteratur som studerades. För att identifiera vilka brister som fördröjer processen och vilka likheter och skillnader det finns mellan Sveriges och Danmarks fastighetsbilningsprocesser genomförde författarna ett flödesschema av fastighetsbildningsprocessen för ägarlägenheter med hjälp av intervjuresultaten för både Sverige och Danmark. Författarna sammanställde 52 förrättningsakter för att få fram genomsnittliga handläggningstider i olika kommuner i Sverige. Motsvarande sammanställning kunde inte genomföras i Danmark eftersom författarna inte fick tillgång till nödvändiga data. I stället kunde den danska respondenten ge en tidsram för fastighetsbildningen i landet.
Resultatet av studien visar att Danmarks fastighetsbildningsprocess är effektivare än Sveriges på grund av att licenserade lantmätare utför fastighetsbilningsunderlagen som sedan skickas vidare till den centrala Geodatastyrelsen, där ett beslut fattas. I Sverige genomförs fastighetsbilningsunderlaget av konsulter till olika kommunala- eller statliga lantmäterimyndigheter. Det som framkom utifrån respondenterna i Sverige är att kraven på handlingsunderlagen skiljer sig mellan olika handläggare och lantmäterimyndigheter. För att effektivisera fastighetsbildningsprocessen för ägarlägenheter föreslår författarna, inspirerade av Danmarks system, att en särskild avdelning för 3D-fastigheter och ägarlägenheter inrättas. Eftersom fastighetsbildningen idag varierar beroende på handläggare och lantmäterimyndigheter, skulle detta leda till en enhetlig fastighetsbildning i hela landet och minska förvirringen kring krav på underlag för fastighetsrättsliga konsulter.
