Abstract [sv]

Forskning visar att det finns brister i hur domstolar beaktar barnets bästa och barnets rätt till delaktighet i beslut som rör dem. Utifrån barnkonventionen, som sedan år 2020 är svensk lag, framkommer det att barnets bästa ska vara avgörande (artikel 3) och barnet har rätt till delaktighet i frågor som rör dem utifrån ålder och mognad (artikel 12). Syftet med studien var att, utifrån kammarrättens domar, undersöka hur barnets bästa beaktas när ett barn blir placerat i familjehem enligt 2 och 3 §§ LVU. Tolv domar från fyra kammarrätter (Göteborg, Jönköping, Stockholm och Sundsvall) från 2024 har analyserats. Resultatet visade att det sällan fanns några konkreta resonemang kring barnets bästa och att det inte beskrevs hur barnets bästa hade vägts in i beslutet. Däremot hade barn i de flesta domar kommit till tals, vissa via ställföreträdare. Kammarrätten resonerade ofta kring trovärdigheten av barnets berättelse samt kring barnets ålder och mognad.

Abstract [en]

Research shows shortcomings in how courts consider the best interests of the child and the child’s right to participate in decisions affecting them. According to the UN Convention on the Rights of the Child, which became Swedish law in 2020, the child’s best interests must be a primary consideration (Article 3), and children have the right to express their views based on age and maturity (Article 12). This study aimed to examine how the best interests of the child are considered in family home placements under Sections 2 and 3 of the Care of Young Persons Act (LVU), based on judgments from the Administrative Courts of Appeal. Twelve rulings from four courts (Gothenburg, Jönköping, Stockholm, and Sundsvall) from 2024 were analyzed. The results showed few concrete discussions on the child’s best interests. However, most children had been heard, some through representatives, and courts often discussed credibility, age, and maturity.
